FoamTerms of Service
These terms are an agreement between you and Level Up Mobile Carwash for use of the Foam app. By creating an account you agree to them. Effective October 30, 2026.
What Foam is
Foam is a marketplace that connects people who want their car washed ("customers") with independent car wash professionals ("washers"). Foam does not wash cars. Washers are independent businesses, not our employees or agents, and they set their own prices and decide which jobs to accept.
Accounts
You must be at least 18, give accurate information, and keep your password secure. You are responsible for activity on your account. One person may not hold multiple accounts to get around a suspension.
Booking and payment
Prices are shown before you book. When you request a wash, your saved card is authorized (held) for the price of the service. The card is charged only when the washer marks the wash complete.
Payments are processed by Stripe. By saving a card you authorize us to charge it for washes you request and for any cancellation fee described below.
Cancellations
Free cancellation: you can cancel a request at no charge any time before a washer accepts it. The hold on your card is released.
Late cancellation fee: if you cancel after a washer has accepted your request (including while the washer is on the way), a $5 cancellation fee is charged to your card, and the rest of the hold is released. The fee compensates the washer for their time and travel.
Once a wash has started, it cannot be cancelled in the app. Contact the washer or our support team if there is a problem.
If a washer declines or cancels your request, you are not charged.
Ratings and conduct
Ratings must be honest and based on your real experience. You agree not to harass, threaten, or discriminate against other users; misrepresent yourself; use the app for anything illegal; interfere with the app's operation; or try to arrange payment outside the app to avoid fees.
Customers must give accurate addresses and vehicle details, have the right to authorize work on the vehicle, and provide reasonable access to it.
Problems with a wash
Because washers are independent, the washer is responsible for the quality of their work and for any damage they cause. If something goes wrong, contact us at support@foamcarwash.app within 48 hours with details and photos. We will help connect you with the washer and may, at our discretion, issue refunds or credits, but we are not responsible for the washer's work.
Suspension and termination
You can stop using the app and delete your account at any time. We may suspend or close accounts that break these terms, create safety risks, or are involved in fraud or chargebacks.
Disclaimers and limits of liability
The app is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim warranties of any kind and are not liable for indirect, incidental, or consequential damages, or for the acts or work of washers or customers.
To the fullest extent allowed by law, our total liability for any claim related to the app is limited to the greater of the fees you paid us in the 6 months before the claim or $100. Some places do not allow these limits, so they may not apply to you.
Indemnity
You agree to cover our losses and legal costs if a claim is brought against us because of your breach of these terms or your misuse of the app.
Governing law and changes
These terms are governed by the laws of California, and disputes will be handled in the state or federal courts located there, unless the law where you live requires otherwise.
We may update these terms. If changes are significant we will notify you before they take effect. Continuing to use the app after that means you accept the new terms.
